Terms of Service
These Terms govern your use of BrightLeft. Please read them carefully — they set out what you can expect from us, and what we ask of you in return.
1. Who we are
BrightLeft is a service operated by BrightLeft Ltd, a company registered in England & Wales. References to “we”, “us” and “BrightLeft” mean BrightLeft Ltd. References to “you” mean the account holder.
2. Acceptance of these Terms
By creating an account, subscribing to a plan, or using BrightLeft in any way, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, you must not use the service.
You must be at least 18 years old and have the legal capacity to enter into a binding contract. By using BrightLeft you confirm you meet these requirements.
3. The service
BrightLeft allows you to record, upload and store encrypted messages — letters, videos, audio recordings and documents — and schedule their delivery to designated trustees at future dates, age milestones, or in the event of your prolonged inactivity.
We provide the service “as is” and “as available”. While we take every reasonable step to ensure reliability and availability, we do not guarantee the service will be uninterrupted or error-free.
4. Your account & security
You are responsible for:
- Keeping your login details, password and any recovery material secure.
- All activity that occurs under your account.
- Ensuring the contact details for your trustees are accurate and up to date.
- Completing periodic check-ins when required by your plan.
We accept no liability for any loss arising from your failure to keep your credentials or trustee information secure and accurate.
5. Encryption & data
Your messages are encrypted on your device before they reach our servers. We do not hold, and cannot access, the keys needed to decrypt your content. This means:
- Your privacy is maximally protected.
- We cannot recover lost passwords or encryption keys. If you lose them, the contents of your messages may be permanently inaccessible — including to you.
6. Fees & billing
All fees are billed through Stripe, our payment processor. By purchasing a plan you authorise us (and Stripe) to charge the payment method you provide.
Free trials. All plans include a free trial period — 7 days for Starter and Monthly plans, and 14 days for the Lifetime plan. Your card is collected at sign-up but not charged until the trial ends. You may cancel at any time before the trial ends and you will not be charged.
Starter & Monthly plans renew automatically each month after the trial. You may cancel at any time from your account settings — your plan will remain active until the end of the paid period. No refunds are issued for partial months already charged.
Lifetime plan. The Lifetime plan is a single one-time charge granting permanent access to BrightLeft for the life of the service. The 14-day free trial is designed to cover the statutory 14-day cancellation period provided under the UK Consumer Contracts Regulations 2014 — you may cancel freely during this period at no cost. Once the trial ends and the one-time payment is taken on day 15, the Lifetime plan is non-cancellable and non-refundable, as the cancellation period will have been fully exercised. There are no recurring charges. This does not affect your statutory rights where non-excludable by law.
Prices may change. Existing subscribers will be notified at least 30 days before any price increase takes effect. Lifetime prices, once purchased, are locked for life.
7. Delivery of messages
We will use commercially reasonable efforts to deliver your messages according to the triggers you have set (a calendar date, a recipient age milestone, or prolonged inactivity as determined by missed check-ins). You acknowledge that:
- Delivery depends on accurate trustee contact details that you provide and maintain.
- Inactivity-based delivery relies on you completing check-ins. If you deliberately cease use of the service while wishing messages to remain undelivered, you must cancel or delete those messages.
- We are not liable for undelivered, mis-delivered, or late-delivered messages resulting from inaccurate trustee data, email provider filtering, recipient device issues, or force majeure events beyond our reasonable control.
8. Your content & responsibilities
You retain full ownership of everything you upload. By using the service you grant us a limited licence solely to store, encrypt, transport and deliver your content in accordance with your instructions.
You warrant that:
- You own or have the right to upload and share each piece of content.
- Your content does not infringe the rights of any third party.
- Your content does not violate our Acceptable Use Policy or any applicable law.
9. Suspension & termination
We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy, particularly those involving illegal content, abuse of trustees, or threats to the safety of our service or other users. Where lawful and safe to do so, we will give you notice and an opportunity to cure.
You may close your account at any time. On closure we will permanently delete your encrypted content within 90 days, except where retention is required by law.
10. Limitation of liability
To the maximum extent permitted by law, BrightLeft's total aggregate liability to you for any claim arising out of or relating to this agreement is limited to the amount you have paid BrightLeft in the 12 months preceding the event giving rise to the claim.
We will not be liable for indirect, consequential, special or punitive damages, including loss of profit, loss of goodwill, or emotional distress, arising from the use of or inability to use the service, except where such liability cannot be excluded by law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
11. Service continuity
Should BrightLeft ever be wound down, we commit to providing:
- At least 12 months' notice to all active members.
- A full encrypted export of every account's content.
- For Lifetime members: a perpetual licence to our open-source delivery tool.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of the service after that period constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of England & Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England & Wales.
